Sam Bankman-Fried will receive early release: the sentence will be reduced by four years
According to calculations by the U.S. Bureau of Prisons, former FTX CEO could be released from prison in December 2044 — four years earlier than the original sentence. Sam Bankman-Fried was sentenced to 25 years in March 2024 for seven counts of fraud and conspiracy, but a good behavior credit system allows for a significant reduction in actual time served.
How the sentence reduction system works in American prisons
The actual time served by the FTX founder is estimated to be around 21 years instead of the 25 years imposed by the court. This is possible thanks to a mechanism known in the U.S. criminal justice system as “good behavior time.” Each inmate can earn an additional credit of 54 days for each year of their sentence. Additionally, incarcerated individuals can receive official sentence reductions through participation in special requalification and rehabilitation programs, which operate in nearly all federal facilities.

Another factor that helped reduce Sam Bankman-Fried’s sentence is the time spent in pre-trial detention before sentencing. After his bail was revoked, he spent two months in jail awaiting trial. Furthermore, the FTX founder earned additional credits for work in prison self-education and skills improvement programs. All these factors are summed up when calculating the final release date.

U.S. Bureau of Prisons representatives explained that such calculations are based on data about the inmate’s behavior during incarceration, participation in self-improvement programs, and time credited before the trial.

In April of this year, Sam Bankman-Fried was transferred to a low-security facility in California. The transfer followed his months of detention in one of the most dangerous federal prisons, known unofficially as “Victimville” due to high levels of violence. Former FTX CEO’s lawyers petitioned for transfer to less harsh conditions, citing his autism diagnosis and lack of prior convictions.

Former Alameda Research CEO, who was both a partner and a witness in the case against Sam Bankman-Fried, received a significantly lighter sentence. Caroline Ellison was sentenced to two years and, according to calculations, should be released this May. The contrast between their sentences reflects differences in their levels of responsibility for the fraudulent schemes of the FTX platform and its associated trading firm Alameda.

While an appeal process may still be initiated or escalated to higher courts, officially, Sam Bankman-Fried is expected to be released in eighteen years.
