SBF withdraws the reconsideration request, claiming inability to obtain a fair hearing from the judge

Deep Tide TechFlow News, April 23, according to The Block, former FTX CEO Sam Bankman-Fried (SBF) submitted a letter to Judge Lewis Kaplan of the Southern District of New York on April 22 local time, announcing the temporary withdrawal of his previous Rule 33 reexamination motion, citing “doubt about obtaining a fair hearing from the judge.”

SBF stated that the motion was independently conceived and mostly researched by himself while in Brooklyn jail, without consulting his lawyers, only sharing drafts with his parents and receiving editing suggestions. His mother, Barbara Fried, had previously filed the motion on his behalf in March. SBF also indicated that he reserves the right to refile the motion after an immediate appeal and a judge recusal ruling.

In November 2023, a jury found SBF guilty of seven counts of fraud and he was subsequently sentenced to 25 years in prison. Prosecutors claimed he led “the largest fraud case in the past decade.” SBF had previously sought a presidential pardon from Donald Trump, but was rejected.
